Algeria
Information on the filing of Patents, Designs and trademarks in Algeria

PATENT REGISTRATIONS

Algeria is a member of the International Convention and of the PCT.

The requirements for filing a non-PCT application in Algeria are as follows:

(a) Name, address and nationality of the applicant;

(b) Power of Attorney in French (simply signed);

(c) Specification, claims, drawings, and abstract in French and Arabic;

(d) Assignment of Invention, if the applicant is not the inventor; and

(e) Certified copy of priority document, if applicable.

The minimum requirements for obtaining a filing date are: name, address, and nationality of the applicant; title in French; specification, claims, drawings, and abstract in French, Arabic or English; and details of the priority application, if applicable (number, country, and filing date). All other documents can be filed within a term of two months except for the certified copy of priority document which can be lodged within a term of three months.

The requirements for filing a PCT application in Algeria are as follows:

(i) Name, address and nationality of the applicant;

(ii) Power of Attorney in French (simply signed);

(iii) Copy of the specification, claims, drawings, and abstract as published by WIPO;

(iv) Specification, claims, drawings, and abstract in Arabic;

(v) Copy of International Search Report;

(vi) Copy of International Preliminary Examination Report; and

(vii) Copy of any changes recorded before WIPO during the International phase.

The minimum requirements for entering the National phase are: name, address, and nationality of the applicant; title in French; and a copy of the specification, claims, drawings, and abstract as published by WIPO. All other documents can be filed within a term of two months.

We estimate that the cost of filing a patent application in Algeria will be between about US$ 2000.00 and US$ 2200.00 (including the first year annuity). To this must be added costs for claiming each priority date at about US$ 100.00 per priority claim, additional publication charges of about US$ 75.00 for every five pages over the first ten, additional publication charges of about US$ 25.00 for every small-sized drawing over the first three, and additional publication charges of about US$ 55.00 for every large-sized drawing over the first two.

In the case of a PCT National phase filing, the second year annuity is due retrospectively on the first anniversary of the International Filing date and must therefore also be paid upon entering the National phase at a cost of about US$ 200.00.

Furthermore, should we be instructed to prepare the necessary translations, our charges for translating from English into French are about US$ 20.00 per 100 words, and about US$ 18.00 per 100 words for translating from English into Arabic.
